April 11, 2019 - U.S Court of Appeals for the Federal Circuit has affirmed the PTAB decision upholding Blacklidge’s non-tracking tack coat technology patents


Blacklidge Emulsions, Inc., a leader in innovative asphalt technologies, is pleased to announce that the U.S Court of Appeals for the Federal Circuit has affirmed the Patent Trial and Appeal Board’s (“PTAB”) decision upholding Blacklidge’s patents covering non-tracking tack coat technology. All claims of the two patents were challenged by Colas Solutions, Inc. at the PTAB and then at the Federal Circuit. The patents, U.S. Patent Nos. 7503724 and 7918624, relate to methods of providing a tack coat between pavement layers. They describe quick-curing asphalt emulsions that do not stick to vehicle tires while maintaining bond strength on treated paving surfaces.
